Presenting Your Case

  
At this Step, the Parties complete their Submission Forms.

  

The Submission Form:

Each party must complete an Electronic Courthouse Submission Form. The Submission Form allows each party to communicate all of the facts, arguments, and law related to their case and to attach or otherwise disclose documentary and other evidence.

  • Preparing the Submission Form: To complete your Submission, simply click on the link below, enter your user name and password, select the Submission Form, and begin completing the Form. You will probably not complete your Submission in a single session. Simply click on the Save feature at the bottom of the Form at the end of each session. (It is always a good idea to click on the Save feature periodically during a session as well.) When you are ready to work on your Submission again, simply log in to your secure workroom from the Electronic Courthouse Home Page and select your Submission Form. This will take you directly to the saved version of your Form.
       
  • Circulating your Form for Comments and Approvals: You may also wish to circulate your draft Submission Form to your counsel, others in your organization, or even the other Party for comment. Simply print or save the Form to your local workstation. Then you may circulate or email copies to others for comment or approval.
       
  • Signing and Filing your Completed Submission: When you are satisfied that your Submission is complete, simply click the Submit feature at the bottom of the Form. For your protection, we also require a signed copy of your Submission Form. Simply print the Form from your browser, add your signature, and fax your signed copy to us at the number on the Form.
       
  • Amendments and Additions Form: Once you have completed and filed your Submission, and have reviewed the Submission of the other Party, you may wish to add or amend your Submission to address issues raised by the other Party. Your original Submission cannot be amended once it has been submitted. Amendments and additions are made through the Amendments and Additions Form. Each party can file only one Amendments and Additions Form – this is your last chance to include all relevant information.
      
    To complete an Amendments and Additions Form, simply click on the link below, enter your user name and password, select Amendments and Additions Form, and begin completing the Form. You may complete the Form in several sessions, or circulate it for comments or approval by saving and printing the Form, as described above.
       
  • Complete Disclosure: Please ensure that all information on which you intend to rely is described in your Submission and any copies of documents are also submitted. Information or documents not disclosed in your Submission cannot be relied on in your Resolution Session, except with the consent of the Resolution Professional.
       
  • Honesty and Integrity: The Electronic Courthouse's Resolution service is a legal process. It results in final and binding legal decisions that are enforceable in courts of law. Complete honesty and integrity is a fundamental element in the process. The Resolution Professional is entitled to find in favour of the other Party or to require one Party to compensate the other for its costs if the Resolution Professional finds that there has been a deliberate attempt to mislead the other Party or the Resolution Professional.
