Getting It
In WritingAt this
Step, the Parties have resolved their dispute through mediation or arbitration, which
results in a final and binding settlement or decision, enforceable in a court of law.
This final Step has 4 components:
- The Resolution Report
- Compliance with the Report
- Archiving and Transcripts
- Exit Survey.
1. Resolution
Report:
- If your dispute is resolved through Mediation, the Resolution will result in a
Settlement. If your dispute is resolved through Arbitration, the Resolution will result in
a Decision.
- Settlement: Most disputes are resolved through Mediation. In these
circumstances, your Resolution Professional will use the final 2 hours of the 6-hour time
period working with the Parties to create a written Settlement, which will be included in
your Resolution Report.
- Decision: Disputes that are resolved through Arbitration result in a
Decision. In these circumstances, your Resolution Professional will use the final 2 hours
of the 6-hour time period working independently to prepare the Decision.
- Whether your Resolution results in a Settlement or Decision, you will receive an
Electronic Courthouse
Resolution Report in our quality-controlled format. The Resolution Report is binding upon
the Parties and enforceable in a court of competent jurisdiction. Your Report will include
a description of the Parties and the dispute, a summary of the facts and arguments relied
on by each Party, and the settlement or decision, with reasons for decision. To view a

2. Compliance:
- At Step 3, the Parties committed to the Rules of Engagement. The Rules provide that all
Resolution Reports are binding and enforceable in court by the Parties.
The Electronic Courthouse clients have participated in a fast, efficient, consensual process. They are committed to
carrying out the terms of the Resolution and have consistently demonstrated extremely high
rates of compliance with the Settlement or Decision.
3. Archiving and
Transcripts:
- Unless both parties have requested otherwise, The
Electronic Courthouse will
create a digital archive of your Resolution process that is stored on a secure digital
storage facility and will be maintained for a 6-month period. You may also wish to make
your own copies of the documents and Forms.
