When litigation is simply too expensive or too time-consuming, the parties engage The Electronic Courthouse for a binding resolution of the issues.

Example...

Millennium Public Relations LLP is a large European advertising agency headquartered in Dublin, Ireland. It purchased a mission-critical suite of online software from Halcion Software Inc., a mid-sized ASP located in Amherst, California. Last month, Halcion's server went down for almost 4 days and, as it was then discovered, a number of their clients' data had not been properly backed up. Halcion's insurer had denied coverage in these circumstances and Millennium was seeking compensation for its losses. Here  is Millennium's perspective:

"We were running campaigns for over 100 clients when Halcion's server went down.  All of our clients' sophisticated campaign materials - logos, art work, press kits, and launch materials - were simply gone. Our clients were furious and we suffered a real blow to our reputation. We had to cancel some market launches and take the hit on some serious out-of-pocket costs for our customers. And - this still makes me furious - we lost some very important accounts."

"Halcion has stepped up and taken some responsibility, but not enough. Their insurer is out of the picture and they're trying to rely on some pretty obscure provisions in the contract. Their solution is totally embedded in our service - we're going to have to come to some agreement - fast.  Suing is simply not a realistic option."

Jeremy Robbins is Millennium's Creative Director. His budget and staff have really taken the hit at Millennium and the CEO has given him the lead on getting the matter resolved. Jeremy does just about everything online these days and he advises Millennium's counsel that he wants to arbitrate - online. After researching the web site and service, Halcion agrees to use The Electronic Courthouse.
