Resources Support

Step 5 - Analysis...

The Electronic Courthouse sets up a ResolutionRoom(TM)for the parties and a confidential Side Room for each party.

Example...

A Resolution date is selected and each party is assigned its own Secure Client Workroom. Here, each may work independently on their own draft documents, sharing them and receiving input and other documentation from their counsel or other designated participants.

Engineering, HR, the CEO... their input and approval may be acquired in each party's Secure Client Workroom before the Submissions are completed and filed in the ResolutionRoom.

The parties will want to assess their bottom line position and prepare draft offers to settle before commencing the Resolution Session. The parties will use the ResolutionRoom and their Secure Client Workroom to better assess the other party's position and consolidate their own.

Let's see how Halcion and Millennium approach this stage:

  • Halcion places its highest premium on customer retention. It needs to keep the level of compensation in check, but hang on to its customers. Its losses can be apportioned over its entire client base and some of the loss is insured. Halcion is willing to cover Millennium's out-of-pocket costs, provided that the claims for damage to reputation and similar amounts are dropped.
  • Millennium places its highest priority on avoiding similar losses. Millennium has indicated that it is willing to settle for out-of-pocket costs, provided that future loss prevention assurances can clearly be demonstrated.

These preferences form the foundation of an agreement. Their Resolution Professional will review draft Offers to achieve a final settlement in writing, executed by the parties. If agreement cannot be reached, the parties will move to arbitration and, through the Decision of the Arbitrator, achieve a final binding resolution of their dispute.
