Step 8 - Settlement or Decision...

Through The Electronic Courthouse's unique "stepped" process, the parties will achieve a final and binding resolution of their dispute. Whether by way of mediation (resulting in a "Settlement" of the parties) or arbitration (resulting in a "Decision" of the Arbitrator), the parties will receive the Report of the Resolution Professional, enforceable like a judgment of the Court.

Example...

Resolution Professional: You are really so very close on the two substantive issues you identified. And, while the other issues are important, they should not prevent you from reaching an overall settlement, in my opinion.

Millennium: Well, what can we do to make this happen?

Halcion: Our company has reviewed your statement of out-of-pocket expenses and finds it agreeable over all. and I believe that your company is satisfied with the significant redundancies we have now built into our server capacity so this absolutely can not happen again.

Millennium: Well, recognition of the loss of clients and damage to our company's reputation arising from your company's previous negligence are also important to us.  However, we are willing to accept coverage of our out-of pocket expenses.

Halcion: I think we have a deal.

Resolution Professional: Let's turn our attention to the draft Offer to Settle and use it to create Minutes of Settlement that you both can sign. They will form part of my Report which will be posted in the ResolutionRoom by noon tomorrow.  Good work!
